Terms of Service

1. The Service

Max Realism is an automated media-processing tool. It re-grades and enhances images and videos you upload — adjusting color, adding grain, treating skin, reducing banding, and re-encoding — so that AI-generated content looks more like footage captured on a real camera. The Service processes the files you provide and returns a processed result. We do not create content for you, and we do not use AI models to fabricate imagery.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service. You may not use the Service if you are barred from doing so under applicable law. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

Some features require an account. You agree to provide an accurate email address and to keep your credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Free trial

We do not offer a free tier. The Monthly plan includes a 7-day free trial for first-time subscribers — see Section 5 for how the trial and billing work. Trial availability is offered as-is and we may change, limit, or discontinue it at any time.

5. Plans, billing, and renewals

• Plans. We offer Monthly ($29/month), Yearly ($199/year), and Lifetime ($299, one-time) plans. Each paid plan includes up to 1,000 generations per calendar month. One processed video or one processed photo counts as one generation. Unused generations do not roll over.
• Payment processor. Payments are processed by Stripe. By purchasing, you also agree to Stripe's terms. We do not receive or store your full card number.
• Free trial. The Monthly plan includes a 7-day free trial for first-time subscribers. You provide a payment method at sign-up but are not charged during the trial. If you do not cancel before the trial ends, your payment method is automatically charged $29 and the Monthly plan then renews each month until you cancel. Cancel any time before the trial ends to avoid being charged.
• Auto-renewal. Monthly and Yearly plans renew automatically at the then-current price until you cancel. You authorize us, through Stripe, to charge your payment method for each billing period.
• Cancellation. You can cancel at any time from your account billing portal. Cancellation stops future renewals and takes effect at the end of your current paid period; you keep access until then.
• Lifetime. The Lifetime plan is a one-time payment for access for as long as we operate the Service. It is not a guarantee that the Service will be available indefinitely and creates no recurring obligation on us beyond providing the Service while we offer it.
• Price changes. We may change prices. Changes apply to renewals after we provide notice.
• Taxes. Prices exclude taxes unless stated. You are responsible for any applicable taxes.
• Refunds. Except where required by law, all payments are non-refundable, including for partially used periods and unused generations. You can cancel at any time to avoid future charges.
• Chargebacks. Initiating a fraudulent chargeback may result in immediate suspension of your account.

6. Acceptable use and prohibited content

You are solely responsible for the content you upload (your "Input") and for the results you create, download, publish, or distribute (your "Output"). You represent that you hold all rights necessary to your Input and that your Input, your Output, and your use of the Service comply with applicable law and these Terms. You will not use the Service to create, upload, process, or distribute any content that:

• is unlawful, or infringes or misappropriates anyone's intellectual property, privacy, publicity, or other rights;
• sexually exploits or endangers minors in any way — we report suspected child sexual abuse material to the authorities and terminate the account immediately;
• is non-consensual intimate or sexual imagery, or sexualizes a real, identifiable person without their consent;
• depicts a real, identifiable person in order to deceive — for example, making someone appear to say or do something they did not — in a way intended or likely to defraud, defame, harass, or mislead;
• impersonates any person or entity, or misrepresents your identity or affiliation;
• constitutes fraud, scams, deceptive advertising, or election or political disinformation;
• harasses, threatens, or defames others, or promotes violence, hatred, or discrimination;
• contains malware, or is used to probe, scrape, overload, reverse engineer, or circumvent the Service, its security, or its usage limits.

You are responsible for complying with the rules of any third-party platform where you publish your Output — including advertising platforms such as Meta — including any requirement to label or disclose AI-generated or synthetic media. We may, but are not obligated to, review, refuse, or remove content, and we may suspend or terminate accounts that violate this section.

7. Your content and the license you grant us

As between you and us, you retain all rights to your Input and your Output. You grant us a limited, worldwide, royalty-free license to host, store, transmit, and process your Input solely to operate and provide the Service to you. We do not claim ownership of your content, and we do not use your Input or Output to train or develop machine-learning models. Inputs and Outputs are retained for no longer than 7 days for quality assurance and abuse prevention, then permanently deleted (see our Privacy Policy).

8. Our intellectual property

The Service — including the website, software, realism engine, design, and the Max Realism name and logos — is owned by Elyon Tech LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted.

9. Third-party services

The Service relies on third parties — for example, Stripe for payments, and Cloudflare for delivery and security, along with our hosting and email providers. Those services are governed by their own terms and privacy policies, and we are not responsible for them.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that results will meet your expectations, that the Service will be uninterrupted or error-free, or that any Output will be suitable for a particular use or accepted by any platform. Results vary depending on the input you provide.

11. Limitation of liability

To the maximum extent permitted by law, Elyon Tech LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the Service. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $100.

12. Indemnification

You will indemnify and hold harmless Elyon Tech LLC and its officers, members, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Input or Output, your use of the Service, or your breach of these Terms or violation of any law or third-party right.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, including for violation of these Terms, without liability to you. Provisions that by their nature should survive termination — including content responsibility, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

14. Changes to the Service or these Terms

We may modify or discontinue the Service, and we may update these Terms, at any time. We will post the updated Terms with a new "Last updated" date and, for material changes, take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Wyoming for any dispute that is not subject to small-claims court, and you waive any objection to venue in those courts.

16. General

These Terms are the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them. Nothing in these Terms creates a partnership, agency, or employment relationship.
